Tennessee Marijuana Laws
Many states have legalized the medical use of marijuana. A growing number of states have legalized its sale for recreational use. Not so Tennessee where marijuana is illegal in Tennessee—period. Possession of less than ½ an ounce of marijuana is a misdemeanor offense. In Tennessee, possession of less than ½ ounce of marijuana is considered simple possession. It is a Class A misdemeanor and carries a maximum sentence of eleven months and twenty-nine days in jail and a fine of up to $2,500.00.
Possession of more than ½ an ounce of marijuana raises the charge from simple possession to possession with intent to manufacture, distribute or sell. Possession with intent is a felony and carries a sentence range of one to thirty years depending on the amount of marijuana involved, your criminal record and certain other factors.
The defense of a case of simple possession or possession with intent to distribute marijuana involves a number of critical factors.
Search and Seizure: Was the search and seizure of the marijuana legal? Was the search performed with your consent or pursuant to a valid search warrant signed by a judge after being satisfied that there was probable cause for the search? If not, the seizure of marijuana must be suppressed and the seized marijuana cannot be used as evidence against you.
