    Tennessee’s Sex Crime Laws

    Tennessee law defines sex crimes as acts that are carried out without a victims’ consent, such as sexual penetration; acts of prostitution and soliciting prostitution; and lewd acts involving a minor. Title 39 of the Tennessee Code breaks down these offenses by the severity of the acts and the circumstances in which they took place. For example: 

    • Rape, a Class B felony with 8 to 30 years imprisonment and a fine of up to $25,000, for a conviction. 
    • Aggravated rape, when a weapon was involved, the alleged victim was injured, or multiple defendants are involved. This is a Class A felony with a maximum 60 years in state prison sentence and a fine of up to $50,000.
    • Rape of a child, when the victim is under 13 years of age, which is a Class A felony punishable by at least 25 years in prison. 
    • Sexual battery and aggravated sexual battery when force, extortion, coercion, or fraud is used in the commission of the crime. Sexual battery is a Class E felony, and aggravating factors could elevate it to a Class B felony, punished by up to 30 years in prison. 
    • Indecent exposure, a Class B misdemeanor, if the victim is over 18 years old, or a Class A misdemeanor when the victim is under 13. 
    • Kidnapping, a Class C felony, or false imprisonment, a Class A misdemeanor, involving a minor victim and a non-parent adult perpetrator. 
    • Prostitution, a Class B misdemeanor; solicitation, a Class A misdemeanor; or promoting prostitution, a Class E felony.

    Sex Offender Registration

    Those convicted for crimes that fall under Tenn. Code Ann. § 40-39-202, such as sexual battery, statutory rape, and more, will be required to register with the Tennessee Sex Offender Registry. In general, those required to register must do so for life unless they have successfully petitioned for release from the registration requirements.
